SC orders adjustment of sentence with already served time in jail

The Appellate Division of the Supreme Court on Monday ordered authorities to adjust the jail term of a criminal with the time he or she already served in jail.

It directed the home ministry to take necessary steps in this regard.

The five-member Appellate Division bench headed by Chief Justice Syed Mahmud Hossain came up with the directives following an appeal filed by Eunus Ali against the trial court verdict that awarded him death penalty in connection with a case.

After the apex court order, Deputy Attorney General (DAG) Biswajit Debnath told The Business Insider Bangladesh that the lower court awarded death penalty to Eunus Ali in connection with a murder case.

He filed the appeal with the High Court and the court commuted his death penalty to life terms.

After the HC verdict, Eunus Ali filed the appeal with the Appellate Division seeking its directive to release him from the jail.

Eunus Ali has already served a total of 26 years jail in the meantime in connection with the murder case.

After holding a hearing on the appeal, the apex court ordered to adjust his imprisonment with the time he had already been behind the bars.

The Appellate Division also directed the authorities concerned to release appellant Eunus Ali, if his serving periods would have been enough in comparison with his sentence.
